The very first action camera was square:

William Fox Talbot, like Daguerre, had used a large camera obscura. But he found the exposure times were far too long. Talbot then realised that tiny cameras using short focal length lenses would concentrate light on a smaller area. Talbot fitted microscope lenses, the best made lenses of the time, to little cameras. His wife called them "mousetraps". One of these very small cameras, measuring only 2.5 inches each side was used by Talbot to take his very first successful photograph.

there's no particular technical aspect to the session so it would only be a design patent they are chasing them over
 
Patents are incredibly complex, and simply stating: the first action camera was actually a similar design, simplifies it to a level that isn't fair on the defendant or plaintiff. Design patents are notoriously hard to enforce, however, when it a huge corporation vs a small manufacturer, even if the corporation may know it cannot legally enforce the patent or win in a court, the corporation may choose to 'scare' the small manufacturer to defend what it sees as its IP. Consequently, the small manufacturer may not simply have the time, resources, or ability to defend itself (let alone the huge stress) and as such, makes the choice to cease any work that infringe.
 
Dident Polaroid have their cube cameras out before gopro had their out ? if so they should then sue gopro.

oh, that phase it's over ("miracle new camera which i need to buy/test.....")....I mean it started with DV minicam, then 808...now I am more or less settled on a "mobius" concept, not only buying/testing those company (such as Yi or viofo) which you can trust for firmware update & support.
