Improper right hand turns on Multi lane roads.

Few weeks ago, almost got into a collision.


Why I dug out the above video is because of the video below posted in reddit.

I stopped when approaching the vehicle making the improper turn, the vehicle making the left turn in the other video ... did nothing to prevent the accident.

I am discovering the graphics on the Ontario handbook aren't really clear or address
  • On right turns with multi lane roads
  • Opposite direction turns on multi-lane road.
The Ontario traffic act, which is a difficult to read document with no graphics does address this.
 
Seems like the cam car in the second video would have the majority of the blame since it was left turn yield. He/she tried to take advantage of the fact that the van had to wait for the pedestrians (who were technically jaywalking) and that didn't work out so well.

The van failed to turn to the right most lane and wait for pedestrians (the pedestrian cross/don't cross changed at 2:59) to which are both against the traffic act. The Ontario drivers hand book states a left hand turning vehicle must wait for the right hand vehicle to complete the turn, but it does not address the situation in a multi lane road where if both vehicles turn into their respective lanes, the turns can be accommodated without incident. At one time the drivers hand book had illustrations showing turns from opposing directions could be done.

I don't think the cam car is at fault here, aside from not driving defencelessly or cautiously. He should have stopped and honked before the collision took place.

(2) Where a driver or operator of a vehicle intends to turn to the right into an intersecting highway, he or she shall, where the highway on which he or she is driving has marked lanes for traffic, approach the intersection within the right-hand lane or, where it has no such marked lanes, by keeping immediately to the left of the right curb or edge of the roadway and he or she shall make the right turn by entering the right-hand lane of the intersecting highway where the lane is marked or, where no such lane is marked, by keeping immediately to the left of the right curb or edge of the roadway being entered. R.S.O. 1990, c. H.8, s. 141 (2).

(3) Despite subsection (2), where more than one lane of a highway has been designated as a right-turn lane, the driver or operator of a vehicle intending to turn to the right into an intersecting highway shall approach the intersection in one of the lanes and leave the intersection in the lane of the intersecting highway that corresponds to the lane from which the turn was commenced. R.S.O. 1990, c. H.8, s. 141 (3).

(1) The driver or operator of a vehicle upon a highway before turning to the left or right at any intersection or into a private road or driveway or from one lane for traffic to another lane for traffic or to leave the roadway shall first see that the movement can be made in safety, and if the operation of any other vehicle may be affected by the movement shall give a signal plainly visible to the driver or operator of the other vehicle of the intention to make the movement. R.S.O. 1990, c. H.8, s. 142 (1)

Diagram 2-20 shows the right hand vehicle turning into the right lane and the left appearing to go into the left after the right, after right completed his turn.

Given the lack of clarity

The pedestrian light changes from walk to don't walk at 2:59.
