One thing to consider is that even if they could, they would have to prove who was driving so you'd have to try and get video of the driver.

No need for that here, for a lot of motoring issues, by default the owner of the vehicle is responsible for the vehicle's actions, so unless he reported it stolen before being charged, or can find someone else who will accept responsibility then the owner gets charged.
